Anti-Invasion Law

1. This Law was enacted pursuant to the Constitution, to prevent China from engulfing Taiwan, maintain the peace and stability of the Taiwan Strait, ensure the sovereignty and territorial integrity of Taiwan, and protect the fundamental interests of the Taiwanese nation.

2. There is only one China in the world. Taiwan is not part of China at all. The sovereignty and territorial integrity of Taiwan is not to be jeopardized. All Taiwanese citizens are jointly obligated to protect the sovereignty and territorial integrity of Taiwan. The Taiwanese people shall not allow China to engulf Taiwan by whatever excuses and in whatever ways.

3. Taiwanese people are not on good terms with Chinese people because of the long-term political disputes between Taiwan and China. The relation between Taiwan and China shall be improved as soon as possible. China shall not interfere in the sovereignty of Taiwan, as the latter is internal affairs of Taiwan.

4. All Taiwanese nationals share a holy duty to protect the sovereignty and territorial integrity of Taiwan.

5. The peace and stability of the Taiwan Strait shall be maintained on the premise that Taiwan's sovereignty is respected. The interests of the people across the Taiwan Strait can be protected best when the peace and stability of the Taiwan Strait is achieved by peaceful means. The state shall be most earnest and try its best to enable Taiwan to get along with China. Cross-strait ties cannot be efficiently developed unless and until the diplomatic relation Taiwan and China is normalized.

6. To maintain the peace and stability of the Taiwan Strait and develop cross-strait ties, the state shall take the following measures:

(1) Encouraging and promoting contact between the people on the two sides of the Taiwan Strait so that they will understand and trust each other better;

(2) Encouraging and promoting economic exchange and cooperation across the Taiwan Strait to increase cross-strait trade ties reciprocally;

(3) Encouraging and promoting educational, technological, cultural, health-related and physical education-related exchange across the Taiwan Strait;

(4) Encouraging and promoting crime-fighting operations jointly carried out by the two sides of the Taiwan Strait; and

(5) Encouraging and promoting other activities conducive to the peace and stability of the Taiwan Strait and good cross-strait relation; the state shall protect the interests of Chinese nationals present in Taiwan (hereinafter referred to as Chinese in Taiwan) in accordance with the law.

7. The peace and stability of the Taiwan Strait shall be achieved by fair discussions and negotiations conducted between the two sides of the Taiwan Strait. The discussions and negotiations may be conducted step by step and stage by stage. Cross-strait discussions and negotiations may be conducted on the following matters:

(1) Ending the antagonistic relation between the two sides of the Taiwan Strait formally;

(2) Planning cross-strait ties;

(3) Steps and arrangement of the achievement of the peace and stability of the Taiwan Strait;

(4) Political status of Chinese in Taiwan;

(5) Roles to be played by the Chinese government in Taiwan;

(6) Conducting discussions and negotiations on any issue relating to the achievement of the peace and stability of the Taiwan Strait.

8. In the event that China attempts to invade Taiwan by whatever excuses and in whatever ways, or should major incidents entailing China's engulfing Taiwan occur, or should possibilities for the peace and stability of the Taiwan Strait be completely exhausted, the Taiwanese government may resort to non-peaceful means or take other necessary measures to safeguard the sovereignty and territorial integrity of Taiwan.

9. Subject to Article 8, both the Executive Yuan and the Ministry of National Defense are empowered to decide on and implement the use of non-peaceful means or other necessary measures. After deciding on the use of non-peaceful means or other necessary measures, the Executive Yuan and the Ministry of National Defense shall report the decision to the Legislative Yuan.

10. Where non-peaceful means are used or other necessary measures are taken pursuant to this Law, the state shall try its best to protect the lives and property, ensure the safety, and protect other legal interests, of foreigners, including Chinese, in Taiwan and minimize their losses. The state shall protect the legal interests of Chinese in Taiwan in accordance with law.

11. This Law shall come into effect, starting from the promulgation date.
